Team Wendy may collect personal information provided by you — such as name, email address, mailing address, phone number, demographic information, and user-generated content - and store those details in a database. We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law; account-related data is retained for the duration of your relationship with us and for a reasonable period thereafter, after which it is securely deleted or anonymised. The legal basis for this processing is our legitimate interest in responding to your enquiries and, where applicable, the performance of a contract with you (GDPR Article 6(1)(b) and (f)). When you use the head-sizing feature in the Team Wendy Community app, our third-party service provider Auglio may collect facial imagery and head measurements through your device's camera to determine your proper helmet size. This data constitutes biometric data under applicable law; we will obtain your explicit consent before any such data is collected or processed. This data is processed by Auglio as our data processor in accordance with Auglio's privacy policy and our data processing agreement with Auglio. Auglio is required to permanently destroy all facial imagery and biometric data promptly after providing your helmet sizing results, and in no event later than three (3) years after your last interaction with the head-sizing feature, and Team Wendy does not store facial imagery collected through the head-sizing feature. The collected information may be used to generate follow-up messages and responses that are tailored to your request. If you have provided your consent to receive our mailings, we may also use the collected information to send you periodic newsletters and other mailings. You may withdraw your consent at any time. Team Wendy does not sell or share (as those terms are defined under the California Consumer Privacy Act) your personal information, and does not rent or otherwise disclose your personal information to third parties for their own marketing purposes. California residents have the right to opt out of the sale or sharing of their personal information; because we do not engage in such practices, no opt-out action is required, but you may contact us at info@teamwendy.com to confirm. If you have any additional questions, or would like to exercise your rights under applicable data protection law - including the right to access, correct, delete, restrict processing of, or port your personal data, or to object to processing - please contact info@teamwendy.com. California residents may also request to know the categories and specific pieces of personal information we have collected, and have the right to non-discrimination for exercising their privacy rights; we will respond to verified requests within 45 days as required by law. When you visit the Team Wendy website or use the Team Wendy Community app, your device may automatically provide us with information such as the web browser or app version, device type, operating system, unique device identifiers, and the previous website you visited if you clicked to our site from another. We also automatically determine your Internet IP address or your Internet service provider’s IP address. When using the app, we may also collect information about your mobile device, including device model, operating system version, and app usage data. We may use your IP address to estimate your general geographic location in order to present you with cookie consent options appropriate to your jurisdiction. Please note that if we are unable to determine your physical location, you will be presented with our default cookies options. Any of this information may be recorded in our server logs or securely collected on our behalf via third-party services. We collect this data on the basis of our legitimate interest in maintaining the security and performance of our Services (GDPR Article 6(1)(f)). This information is irreversibly anonymised and used only internally in aggregate reporting, and raw log data is retained for no longer than 90 days.
